In Ohio, there are several different ways to end a marriage:
Divorce : In Ohio the reason(s) for a divorce usually do not affect the distribution of property, assets, and debts of the marriage. The reasons for the divorce can be very important in settling the terms of child custody, child support, grandparents’ rights, and spousal support / alimony. Our Ohio divorce lawyers can help you work through each aspect of a divorce settlement or, if necessary, by aggressively litigating your case in court.
Dissolution: Marital dissolution allows Ohio couples to end a marriage more quickly and amicably than by the divorce process. Outside of court, spouses work together, usually with at least one lawyer, to finalize all the terms of the dissolution and then present a Petition for dissolution to the court. After a hearing in which the judge ensures that both parties do indeed want to dissolve the marriage, provided both parties appear and indicate their agreement to the terms of the dissolution, the settlement is typically approved and the marriage is dissolved.
Legal Separation: Legal separation does not involve ending the contract of marriage. Instead, it allows couples to essentially establish separate lives without losing many of the legal benefits of the marriage. For example, a separated couple could establish an agreement for custody and visitation of children, the payment of the mortgage, and temporarily provide for issues affecting their children while remaining on the same health insurance plan.
Military divorce: A divorce becomes more complicated when one member of a couple is a member of the armed services. The issues are too complex to be covered here. Please contact us to speak with an attorney about a possible military divorce.
